TERMS AND CONDITIONS
Deposits and
Cancellations: A reservation deposit of $250 holds your space and will
be credited against your final payment, which is due not less than 60 days
before the trip. If full payment is not received within 60 days prior to
departure, we may consider your reservation cancelled. In the event of
cancellation by The Learning Trips, Inc., (TLT) all payments received from
tour participants will be refunded within 5 days of cancellation. For
cancellation by participants, all cancellation notices must be received in
writing and will become effective only when received by TLT. Refunds will
be made upon receipt of written notice and the following fees will apply:
If cancelled 61 days prior to tour start date, a $100 administrative fee
per person will be charged; 60-45 days prior to start to tour start date,
a $200 per person fee will be charged; 44-31 days prior to tour start
date, a $400 per person fee will be charged; 30-15 days of tour prior to
tour start date, 50% of tour price will be charged; 14-8 days, 75% of
tour price will be charged; 7 days or less, no refund. IMPORTANT - REFUND
POLICY APPLIES TO LAND PACKAGE ONLY.
Limitation of
Liability: TLT and One By Air, Inc., (OBA) and its agents act only as
agent for you with respect to services provided by others including, but
not limited to, hotels, restaurants, sight-seeing and transportation. The
tour operators and agents shall not be responsible or liable for any
injury, loss, damage, delay or inconvenience arising out of or in
conjunction with any defect in any vehicle or any act, omission, neglect,
accident, error, or default of any company or person engaged in providing
such hotel, restaurant, sight-seeing, transportation or other services of
the tour. The tour operators and agents reserve the right to change the
itinerary due to circumstances beyond our control. If this is necessary,
we will resume the scheduled itinerary as soon as possible. If any tour
must be withdrawn by TLT or One By Air Tours prior to tour departure,
liability is limited to a refund of money received by us.
Your Tour Price
Includes: all hotel and lodging, most meals, bilingual naturalist
guides, all taxes, tips, transfers, admission fees and transportation
within Costa Rica. We are happy to assist you in free-time activities. A
detailed itinerary will be provided at time of booking.
Applicants accepted on
a first-come, first served basis. Adults are welcomed and encouraged to
participate in The Learning Trips.
Travel Insurance:
One By Air, Inc. is proud to offer tour participants the finest travel
insurance available. This type of comprehensive travel insurance coverage
may give you the "peace of mind" that can make your trip more enjoyable.
Additional information on our insurance coverage and an application form
will be included with your confirmation letter.
Release and
Agreement
By enrolling on this
tour, participants have made the choice to travel with the teacher/group
leader organizing the group, and understand that this choice is not the
responsibility of TLT or OBA. TLT may provide a replacement group leader
should my original group leader be unable to, or determine not to,
participate in the tour. Participants must secure the necessary travel
documents (passport and visa[s]); failure to do so does not constitute
grounds for refund except according to normal cancellation guidelines
outlined above. If participant becomes ill or incapacitated TLT and its
employees, or group leader may take action they deem necessary for his/her
safety and well-being, including securing medical treatment (at
participants expense) and transportation home.
Participants agree to
abide by all local laws when abroad, including those concerning drugs and
alcohol. Failure to do so is to waive the right to a refund of any part of
the program fee, and that violation of such laws allows TLT to send
offender home at his/her own expense. Participants will be required to pay
for any phone calls or incidental personal expenses occurred at hotels, as
well as any damage caused to hotel rooms or busses.
Participants agree to
release One By Air, Inc. (which term shall include officers, shareholders,
and employees, as well as OBA itself) and school and group leaders from ,
and agree to not sue such persons for, any claims that arise from, or in
connection with, any physical or property damage suffered from any cause
whatsoever other than the actual negligence of such persons. Without
limiting the generality of the foregoing, participants agree not to sue
such persons for, any physical or property damage suffered as a result
from acts of God, war, strikes or government restrictions, terrorist
activities, or the acts or omissions of any other agents over which such
persons have no direct control, including, without limitation, airlines,
bus companies, railways, shipping companies, hotels, guides, and
sub-contracted agents or tour operators.
This tour has been
designed in its pacing, educational content and other aspects of the tour
for students. |
